1. Introduction

These Terms and Conditions ("Terms") govern the provision of all drug screening and safety training services (the "Services") by America's Best Choice Drug Screen and Safety Training Center ("ABC," "we," "us," or "our") to our clients ("Client" or "you"). By using our Services, you agree to be bound by these Terms.

2. Drug and Alcohol Testing Services

A. Consent: By submitting to a drug or alcohol test at our facility, you consent to the collection and analysis of your specimen(s) for the presence of prohibited substances. You also authorize the release of the test results to your employer or the designated requesting entity.

B. Specimen Collection: Our staff follows strict procedures for specimen collection, including those mandated by the Department of Transportation (DOT) and other regulatory bodies, to ensure the integrity and accuracy of the process. We will not be liable for any claims arising from a refusal to provide a specimen or any attempts to tamper with or adulterate a specimen.

C. Testing and Results: All specimens are sent to a certified laboratory for analysis. Negative results are typically available within 24-48 hours, while non-negative results may take longer due to further confirmation testing and review by a Medical Review Officer (MRO). The MRO will attempt to contact you to discuss any non-negative results and to inquire about any valid medical explanations for the presence of a substance.

D. Confidentiality: We maintain the confidentiality of all test results in accordance with applicable federal and state laws, including the Health Insurance Portability and Accountability Act (HIPAA). We will only release results to your employer or other parties as authorized by law or your written consent.

E. Disclaimer: We are a collection and training facility. We are not responsible for the consequences of a test result, including but not limited to employment decisions, disciplinary actions, or legal proceedings. Any dispute regarding the accuracy of a test result must be addressed with the testing laboratory and/or the MRO.

3. Safety Training Services

A. Course Content: Our safety training courses are designed to provide general knowledge and are not a substitute for professional advice or on-the-job training. We do not guarantee that completion of a course will prevent all accidents or injuries.

B. Certification: Upon successful completion of a training course, we may issue a certificate of completion. This certificate only confirms that you have attended the course and, where applicable, passed the required examination. It does not certify your proficiency or competence in a specific skill.

C. Client Responsibilities: It is your responsibility to ensure that all participants in our training courses are physically and mentally capable of performing the training exercises and understand the course material.

4. General Provisions

A. Limitation of Liability: To the fullest extent permitted by law, ABC will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our Services. Our total liability for any claim arising out of these Terms or the Services shall not exceed the amount paid by you for the specific Service in question.

B. Governing Law and Jurisdiction: These Terms and any disputes arising from them shall be governed by the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding related to these Terms will be brought exclusively in the state or federal courts located in Odessa, Texas.

C. Indemnification: You agree to indemnify and hold harmless America's Best Choice Drug Screen and Safety Training Center, its employees, and agents from any and all claims, damages, losses, or expenses (including attorney's fees) arising from your use of our Services or your breach of these Terms.

D. Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed from these Terms, and the remaining provisions will remain in full force and effect.

E. Amendments: We reserve the right to amend these Terms at any time. The updated Terms will be effective upon posting to our website or providing you with a copy. Continued use of our Services after any such changes constitutes your acceptance of the new Terms.
